Damned if this didn’t make my entire day! Yeah, McCain’s speech was excellent and helped me sleep better last night, but this news story ROCKS!

BLUE MOUND, Texas â€??? When two gunmen smashed through the glass front door of her suburban Fort Worth home, Kellie Hoehn didn’t think twice.

The 34-year-old mother of two grabbed a shotgun that had been pointed at her face early Wednesday, starting a struggle that ended with one intruder killed with his own weapon and another in the hospital.

“I wasn’t going to let them get to my babies,” she said, recalling the moment when she pushed up the muzzle of the shotgun, pointing it away from her children’s rooms.

Although the intruders told her to keep quiet, she screamed for her husband. She told her 12-year-old son, who was awakened by the sound of the shattering glass front door, to get his 5-year-old sister and hide.

“It was like a horror movie,” her husband, 32-year-old Keith Hoehn, told the Fort Worth Star-Telegram. “I thought I was a dead man. We’re fighting for our lives.”

With Kellie Hoehn clinging to the weapon’s muzzle, her husband tackled the man who held the shotgun. She knocked the intruder in the head with a jar candle, giving her husband a chance to wrest the shotgun.

By then the tussle had spilled out onto the front lawn. Keith Hoehn shot one of the men who had a pistol, police said. Wounded, that man ran away.

Then the intruder who initially had the shotgun charged Keith Hoehn.

Kellie Hoehn told The Dallas Morning News that she screamed at her husband, “Shoot him, shoot him, shoot him.”

Her husband fired the shotgun and the man fell to the ground. Then the shot man lunged a second time.

“Well, I shot him again, and I guess that was it,” Keith Hoehn said.

Dakota Scott Benoit, 20, of Richland Hills, was pronounced dead at a hospital. John Garland Pierson, 25, of Haltom City, was in critical condition and in police custody at the hospital.

“I am not happy that someone is dead,” Kellie Hoehn said. “But I am glad that my family is alive.”

Police said Pierson was shot in the left arm and the bullet pierced his diaphragm and other organs but his condition was improving. He will face charges of burglary of habitation with intent to commit another felony, police said.

Investigators say the couple were just defending their family and probably won’t be charged.

Probably, hell! They had better NOT be charged! :evil:

I am an Alabama resident who recently renewed his pistol license with the Sheriff’s Office downtown. During renewal, the clerk advised me that unconcealed pistol carry was not permitted in Alabama. This information is inaccurate, and I feel compelled to address the issue. I aim to clear up the legality of unconcealed pistol carry as well as inquire as to how Law Enforcement will handle encounters with law-abiding citizens who carry their pistols in an unconcealed manner.

Numerous Alabama courts have ruled on the matter of unconcealed carry, and have always upheld this right.

In The State v. Reid, 1 Ala. 612; 1840 Ala.:

“Under the provision of our constitution, we incline to the opinion that the Legislature cannot inhibit the citizen from bearing arms openly, because it authorizes him to bear them for the purposes of defending himself and the State, and it is only when carried openly, that they can be efficiently used for defence.�?

In K.J v. State, 690 So. 2d 541; 1997 Ala. Crim. App.:

“[T]here is a conflict between the two statutes. Section 13A-11-52, like § 13A-11-50, does not permit the carrying of a pistol outside of a person’s own premises under any circumstances. However, that section does begin with the phrase ‘except as otherwise provided in this article.’ â€??

The Court continues:

“Section 13A-11-73 does not prohibit carrying an unlicensed pistol if the pistol is unconcealed and the person is on foot. ( . . . ) Ala. Code § 13A-11-52 applies only the extent that it is consistent with Ala. Code § 13A-11-73 because it is the later statute and a complete revision of the subject matter.�?

Another relevant case is Morris v. State, 342 So. 2d 417; 1977 Ala. Crim. App.:

“The State’s evidence . . . shows that the pistol was in a scabbard or holster, worn on the side and was not covered. We call attention to Title 14, § 175, Recompiled Code 1958,† which reads:

‘No person shall carry a pistol in any vehicle or concealed on or about his person, except on his land, in his own abode or fixed place of business, without a license therefor as hereinafter provided.’

“It is to be observed that this law prohibits carrying a pistol (concealed or not) in any vehicle or ‘concealed on or about his person, except . . . without a license therefor . . [**4] . .’ It does not prohibit an unconcealed pistol.â€??

† Note that the section cited in the above case has since been re-codified as § 13A-11-73, and is identical in wording.

In case there still remains any doubt as to the legality of unconcealed carry, Looney v. State (41 Ala. App. 582; 141 So. 2d 535; 1962 Ala. App.) puts the matter to rest succinctly:

“Code 1940, T. 14, § 175, ‡ as amended, makes it an offense for a person who has no license therefor (except on his land, abode or place of business):

1) to carry a pistol in any vehicle; or

2) to carry a pistol concealed on or about his person.

Thus, a permit is not required when a person afoot carries an unconcealed pistol.�?

‡Again, note that the section cited in the above case has since been re-codified as § 13A-11-73, and is identical in wording.

Now that I am confident you have been duly informed as to the legality of unconcealed carry of firearms in public, it would be prudent to address the issue of unconcealed carry on private premises. The first relevant section of the Code of Alabama on the issue is § 13A-11-52:

“Except as otherwise provided in this article, no person shall carry a pistol about his person on premises not his own or under his control . . .�?

At first reading, it appears § 13A-11-52 prohibits unconcealed carry in private establishments. However, note the boldface “[e]xcept as otherwise provided in this article.�? The Code of Alabama does “provide otherwise,�? in § 13A-11-73:

“No person shall carry a pistol in any vehicle or concealed on or about his person, except on his land, in his own abode or fixed place of business, without a license therefor as hereinafter provided.�?

A person having been issued a pistol license is not subject to § 13A-11-52 unless the owner of the premises informs said person that firearms are not permitted at the premises. In an opinion (AGO 1984-205) regarding unconcealed carry, the Attorney General concurred with this interpretation of the law:

“2. May a person carry an unlicensed and unconcealed pistol anywhere, either on his own property, on the public highways, public property or on the land of another person without violating 13A-11-52 or 13A-11-73? (providing he is not riding in a vehicle.)

( . . . ) [Y]es, generally, however, “anywhereâ€?? is a broad term. There may be individual or specific restrictions… landowners or residents may exclude licensees or invitees who do not comply with their rules prohibiting firearms . . .â€??

Furthermore, should any county or municipality wish to prohibit unconcealed carry, such an ordinance would run afoul of Code of Alabama § 11-80-11:

“No county or municipal corporation, instrumentality, or political subdivision thereof, by ordinance, resolution, or other enactment, shall regulate in any manner gun shows, the possession, ownership, transport, carrying, transfer, sale, purchase, licensing, registration or use of firearms, ammunition, components of firearms, firearms dealers, or dealers in firearm components.�?

As you are now aware as to the legality of unconcealed carry, I would like to know how your departments will handle encounters with law-abiding citizens carrying their pistols unconcealed. How will calls to your dispatchersâ€???e.g., “There’s a man with a gun!â€??â€???be handled? Will your deputies be educated as to the legality of unconcealed carry?

ruger mk3 Bill Rugers Rimfire Pistol

Actually, I’ve wanted one for years, but never really could justify it. With the realization that I’ve fired my Ruger .22 caliber revolver enough to wear out the trigger it came to me that I might actually shoot the revolver to death before I can pass it on to my son.

Suddenly, Justification! :idea:

What a great design! Simple and rugged. Every bit as reliable as his single action revolver design, (…and if you know me then you know that’s a serious endorsement on my part…), Bill Ruger’s idea for the semi-auto rimfire pistol has lasted since 1949 with only minor modernizations required. Quoting the Sturm-Ruger website:

Intended for target shooters, plinkers, hikers, campers, and small game hunters, they have been used as the standard target and training pistol by the U.S. Armed Forces, and have won countless target matches worldwide.

The Bull can honestly say that he has seen these sweet little pistols often in the field in the midst of all of those listed outdoor pursuits – and often in the Winner’s Circle back when he shot in IHMSA competition way back when. Can’t swear to the military uses, but I’ve got no reason to doubt that it is true.

When I first ran into the Ruger Standard, it was available in any configuration you wanted – so long as it was blue and had a 4.75 inch barrel. Not so any longer! As time went on, Sturm, Ruger & Co., Inc. paid attention to what the public wanted. Over the years there have been specialized 10 inch barrel models for those long range silhouette shooters, slab-sided versions, fluted-barrel versions, ‘Hunter’ versions, adjustable sighted versions, commemorative versions, stainless steel (of course), one that feels like a 1911, and a fine mix of all of the above. Yep, they may have started out as plain as Mr. Ford’s Model T, but (like the Ford) Ruger has spread out to give consumers everything they asked for – and more. Granted, not all of these configurations are still listed. Why should they? After all, styles and taste change.

Fortunately for The Bull, Mr. Ruger’s ‘Standard’ version with a blued finish, fixed sights, and a 4.75 inch barrel is still in the catalog. Soon one will find its way into my gun oil stained hands. I hope it is very soon!

While sitting here working on the layout for a future post on holster makers, such as ‘Simply Rugged‘ from Alaska, I began thinking about the act of ‘packing iron’ itself. Not the all-to-often debated points of why someone carries a concealed weapon, but rather what the effects are on said person’s mind.

Since I’m isn’t a bloody shrink I can’t tell you what other folks may be thinking. However, I’ll gladly tell you what is running through my little grey cells.

The Bull is – most definitely – a firm believer in the 2nd Amendment of the Constitution of the United States of America. I’m also very much in love with the rest of that most beloved of documents as well. I do have a pistol permit and I legally carry a handgun pretty much all the time. Here in my Pasture I don’t even notice the mass of the gun anymore. Regardless of how & where I’m carrying it on any given day, (and that depends on how I’m dressed for the weather or my destination). That is in the comfort of my very own home though…

When I step beyond my yard, be it in our car or on foot, I immediately feel the intense pressure of responsibility hit me. The first time I felt that weight I found it rather odd. After a lifetime of carrying weapons of one type or another back and forth to the range, or for days on end during the hunt, you’d think I’d be immune. No! This is different! This isn’t like before where only targets were in danger or where a missed shot at a game animal means nothing more than a missed meal. Carrying a concealed weapon means that I have shouldered the responsibility for something that could mean either Life or Death for myself and/or others. *IF* I should ever be in a situation where this firearm is drawn for use there is a very good chance that someone’s life will be lost – or at least be changed forever. Mine if I failed to see and stop a threat in time, or some other person because they presented a threat to my life or someone else’s. I feel that weight with every step I take in public. While I don’t notice the gun at home, when I’m out it seems that every tiny movement reminds me of the unique, (in today’s “modern” society), and heavy burden of responsibility I have taken on as a pistol permit holder.

There is some good, no, ‘great’ news in this though… The Bull, as a CCW holder, is now counted among the safest and most reliable of America’s firearms owners – already the World’s most responsible firearms owners, (and among the last). Despite the angry rhetoric from the Leftist, America’s legal firearms owners are law-abiding to an extreme, patriotic beyond measure, and exceedingly SAFE and DEPENDABLE. Out of curiosity I spoke with our local constabulary and asked if the issuance of pistol permits had caused and noticeable changes in crime such as robbery and assault locally.
I expected no straight answer, but I got one anyway.

The answer is YES. Crime is lower now that the citizenry is being legally armed against the criminals. Seems that thugs are thinking twice about violent crime when the possibility of getting shot down in the act is far greater. The Bull thinks that is as it should be.
